Privacy Policy
Albert Sports, LLC d/b/a Chirpr (“Chirpr,” “we,” “our,” or “us”) respects your privacy and is committed to protecting it through our compliance with this policy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use the Chirpr mobile application, website, and related services (collectively, the “Service”).
1. Information We Collect
1.1 Information You Provide to Us
- Account Data (Optional). If you create an account (e.g., by registering a username or linking an email address), we collect the information you provide such as username, email, or other identifiers.
- User-Generated Content. Messages, reactions, comments, images, or any other content you post or transmit via the Service (“Chirps”).
- Customer Support. Content of any messages you send to our support team, including attachments.
1.2 Information We Collect Automatically
- Device Identifiers. A hashed device UUID or similar token that does not personally identify you but allows us to maintain session state, combat spam, and apply preferences.
- Usage Data. Log files, crash reports, pages viewed, in-app screens visited, time stamps, and interaction events (e.g., emoji reactions) collected via first-party analytics.
- Cookies & Similar Technologies. Our website uses strictly necessary cookies and local storage to keep you logged in and remember preferences. Optional analytics cookies are only set with consent where required by law.
2. How We Use Your Information
We use your information to:
- Provide, operate, and maintain the Service and its core features;
- Personalize your experience and deliver relevant content;
- Monitor and improve performance, debug, and develop new features;
- Detect, investigate, and prevent fraudulent or malicious activity;
- Respond to user inquiries, comments, and support requests;
- Comply with legal obligations and enforce our Terms of Service.
3. Legal Bases for Processing (EEA & UK)
If you are in the European Economic Area or United Kingdom, our legal bases are: (a) Performance of a contract (to deliver the Service); (b) Legitimate interests (for security, analytics, and improvement); (c) Consent (where we request it, e.g., for optional cookies); and (d) Legal obligation.
4. Disclosure of Your Information
- Service Providers. Vendors who help us host, maintain, and analyze the Service (e.g., AWS Lightsail, Cloudflare, or analytics tools). These providers may access data only to perform tasks on our behalf and are bound by confidentiality.
- Corporate Transactions. Information may be transferred in connection with a merger, acquisition, or asset sale.
- Legal Requirements. We may disclose data if required to do so by law, court order, or to protect the rights, property, or safety of Chirpr, our users, or others.
- With Your Consent. We may share or publish content (e.g., featured Chirps) when you explicitly agree.
5. Data Retention
We retain User-Generated Content for as long as your account exists or as needed to provide the Service. Device identifiers and analytics logs are typically deleted or anonymized within 24 months. We may retain information longer where necessary to comply with our legal obligations, resolve disputes, or enforce agreements.
6. Security
We employ industry-standard technical and organizational measures—including TLS encryption in transit, least-privilege access controls, and regular security audits—to protect your information. However, no Internet transmission or storage system can be guaranteed 100 % secure.
7. Your Rights & Choices
7.1 GDPR / UK GDPR
You have the right to access, correct, delete, or port your personal data, and to object to or restrict certain processing. You may withdraw consent at any time without affecting the lawfulness of processing based on consent before its withdrawal.
7.2 CCPA / CPRA (California)
California residents may request (i) a list of categories of personal information we have collected, disclosed, or sold (we do not sell personal information); (ii) deletion of personal information; and (iii) to opt out of “sharing” for cross-context behavioral advertising. We will not discriminate against you for exercising these rights.
7.3 Opt-Out of Analytics
You can opt out of optional analytics in the in-app settings or by enabling “Do Not Track” in your browser, where honored.
8. Children’s Privacy
The Service is not directed to children under 13 (or under 16 in the EEA), and we do not knowingly collect personal data from them. If you believe we have inadvertently collected such data, please contact us so we can delete it promptly.
9. International Transfers
We are headquartered in the United States. Where data is transferred outside your jurisdiction, we rely on standard contractual clauses or other approved safeguards to ensure adequate protection.
10. Changes to This Policy
We may update this Privacy Policy from time to time. We will post the revised version with an updated “Last updated” date and, where material changes are made, provide prominent notice or obtain your consent as required by law.
